June 2023: New York Attorney General Letitia James filed a lawsuit against Centers Health Care and four of its 38 New York nursing facilities, alleging that the owners committed fraud by misusing public funds, neglecting residents, and violating nursing home regulations. The suit alleged that the company’s executives stole more than $83 million in Medicare and Medicaid funds for their own profit, leaving elderly residents dead, neglected, or humiliated in the Bronx, Queens, Westchester, and Buffalo.
December 2019: A Manhattan jury awarded over $5 million to the widow of a Northern Manhattan Nursing Home resident. The lawsuit alleged that the victim went into hypoglycemic shock after the facility failed to monitor his blood sugar and provide timely medical attention. The delayed care caused the victim to suffer permanent brain damage, and he died after six months in a coma and on a feeding tube.
State Interventions and Settlements
In some cases, the state may also take action against nursing homes in New York City to raise the standard of care.
In November 2024, a civil lawsuit against Centers Health Care settled for $45 million. Centers operates four nursing homes in New York, including Claremont Village Assisted Living in the Bronx. The state attorney general filed the lawsuit, which alleged that the facilities neglected and mistreated residents. According to the lawsuit, some residents were forced to sit in their urine and feces for hours, and many suffered injuries due to poor supervision.
The settlement included $35 million for improving resident care and staffing. Another $8.75 million was restitution to Medicaid and Medicare. The court also appointed independent monitors for operations and finances in hopes of reforming the facilities.
