In June 2023, the New York Attorney General reported that the owners, operators, and landlords of four New York nursing homes misused over $83 million in taxpayer money, leaving elders in their care dead, neglected, or humiliated. Centers Health Care, which owns and operates all four facilities, was accused of enriching its executives by diverting Medicare and Medicaid funds away from residential care. The facilities included:

Buffalo Center for Rehabilitation and Nursing (Buffalo)
Holliswood Center for Rehabilitation and Healthcare (Queens)
Martine Center for Rehabilitation and Nursing (Westchester)

Because of the misuse of funds, residents at the facilities suffered from severe dehydration, malnutrition, sepsis, and other infections from untreated bedsores, life-changing injuries from falls, and even death. Insufficient staffing made staff unable to assist residents with basic daily activities, and call bells were routinely ignored. The state reached a settlement with Centers Health Care in 2024, ordering the company to pay $45 million in damages.

$750,000 Verdict – Nursing Home Wrongful Death in Brooklyn

In January 2022, a nursing home owned by a real estate mogul was ordered to pay $750,000 in damages to the family of a now-deceased resident for failing to provide her basic health services before her death. A jury found that the Linden Center for Nursing and Rehabilitation in East New York violated 90-year-old Olive Roberts’ rights and failed to provide proper care she was entitled to under state public health law.

In her last months at Linden, Roberts developed a severe pressure wound on her lower back because staff were not shifting her position frequently. By the time her family found out, the wound was a stage four bedsore—deep, badly infected, and requiring intravenous antibiotics. It was so deep that part of Roberts’ sacral spine was exposed. She died after being transferred to a hospital in 2017.

$12 Million Settlement – Nursing Home Neglect in Syracuse

In August 2025, the New York Attorney General reached a $12 million settlement with the Van Duyn Center for Rehabilitation and Nursing in Syracuse after a years-long investigation into neglect, abuse, and financial fraud. According to the investigation, the facility’s owners diverted tens of millions of dollars from resident care, pocketing millions in taxpayer funds.

As a result of the alleged fraud, almost 500 nursing home residents were routinely neglected, resulting in death, dehydration, and infections. One resident was admitted to the hospital with a bacterial infection and bedsores after staff failed to respond to her rapidly deteriorating condition.

How Long Do I Have to File a Nursing Home Bedsore Lawsuit in New York?

In New York, the statute of limitations, or filing deadline, for nursing home abuse and neglect lawsuits varies based on the circumstances of the case. Most bedsore cases involve simple negligence, which has a three-year statute of limitations. However, in cases of medical malpractice, victims and their families have two and a half years from the date of the malpractice or the end of continuous treatment by the offending health care entity to file.
